Article 1 - Object
These terms are deemed established between www.tipimentrodrigues.com and any person validating an order, hereinafter referred to as the Customer.
These general conditions constitute a distance selling contract and apply to all sales unless previously agreed in writing between the parties. The customer is deemed to have read these conditions.
These general conditions define the terms and conditions under which the Customer orders, purchases, and receives the delivery of the products presented and sold by www.tipimentrodrigues.com within the framework of distance selling.
Article 2 - Application
Any order implies full and unconditional acceptance of these general conditions. Any document other than these general terms and conditions of sale, including catalogs, instructions, advertisements, brochures, product descriptions, has only informative and indicative value, and is not contractual.
Domaine Hermitage France may modify these general sales conditions without notice. The modifications are then applicable to any order subsequent to this modification.
The Customer is invited to carefully read the current General Conditions of Sale.
The fact that one of the parties does not invoke one of these conditions cannot be interpreted as a waiver of invoking it subsequently.
Article 3 - Products
The products offered on the website www.tipimentrodrigues.com are presented and detailed so that any Customer is able to know the essential characteristics of the products they wish to order.
Product availability will be definitively confirmed upon confirmation of shipment of the order, which will be sent to the Customer by email.
Products are provided at the prices displayed on the website at the time of order validation.
Prices are displayed in euros and do not include delivery charges.
Article 4 - Order
Any purchase order for products on the website www.tipimentrodrigues.com, accompanied by payment or a possible deposit, constitutes an order. Validation of the shopping cart constitutes an order.
Article 4.1 - Account Creation
Creating an account is optional for placing an order. However, creating an account allows the Customer to keep a history of their orders.
The customer who wishes to create an account agrees to provide the information necessary for processing their order, including, title, first name, last name, postal address, email address, telephone number, password for which the customer remains fully responsible.
In accordance with Law No. 2000-300 of March 13, 2000, this information constitutes the identity of the Customer and binds them to any order.
This information is solely for the efficient processing of the Customer's order. Domaine Hermitage France undertakes not to sell or rent the Customer's information to third parties.
The customer can request deletion of their account or delete it via their account.
Article 4.2 - Order Validation
On each product page, the Customer can add products by clicking Add to Cart.
The customer is free to choose their method of payment from those offered.
The customer must pay particular attention to the information provided in their identity, as errors may affect the processing of their order. The information provided by the customer is binding. In the event of an error by the customer in the choice of products or in the labeling of their contact details, www.tipimentrodrigues.com or Domaine Hermitage France cannot be held responsible for these errors or their consequences.
Each order entry is summarized before the Customer is invited to validate their order by proceeding to payment.
Before making payment, the customer is invited to confirm acceptance of the General Terms and Conditions of Sale.
Article 4.3 - Confirmation of Order Receipt
www.tipimentrodrigues.com acknowledges receipt of the order upon validation by sending an email confirmation of the order to the email address provided by the Customer. The email summarizes the order, the order number, the products selected by the customer and their prices, the delivery address, and the billing address.
An invoice will be attached to this email.
Article 5 - Payment
The customer is free to choose their method of payment from those offered by completing the payment information. The customer can proceed to payment only if they validate acknowledgment of the conditions by checking the box provided for this purpose.
Payment is made in euros.
www.tipimentrodrigues.com uses the Monetico payment portal by CIC to ensure the security of its customers' banking information. The customer's bank account or credit card is debited at the time of the customer's order.
Article 6 - Deliveries
Article 6.1 - Delivery Times
After receiving full payment, delivery will be made to the address indicated by the Customer.
Delivery times are provided for informational and indicative purposes only.
www.tipimentrodrigues.com offers standard postal delivery.
Under no circumstances will www.tipimentrodrigues.com be liable for any deterioration of products, in the event of late collection of products from the carrier, or non-collection of products by the customer.
The risks are the responsibility of the Customer upon delivery of the order to the address indicated by the customer.
8 Article 7 - Retention of Ownership
The products remain the property of www.tipimentrodrigues.com until full payment of their price and delivery charges.
9 Article 8 - Receipt of the Order
Upon delivery, the customer becomes the custodian and guarantor of the products.
The customer is required to check the condition of the delivered products.
In case of damage or loss, the Customer must file a claim with the delivery provider of www.tipimentrodrigues.com by registered letter with acknowledgment of receipt within three (3) days (public holidays not included) from the day of receipt of the order.
The customer must send a copy of this letter by mail or email to www.tipimentrodrigues.com.
10 Article 9 - Warranty
The customer has 3 days (excluding public holidays) following delivery to report defects. No report will be admissible if made more than 3 days after delivery of the products.
Defects and damage to delivered products resulting from abnormal and unsuitable storage and/or conservation conditions at the customer's premises shall not entitle the customer to the warranty provided by www.tipimentrodrigues.com.
By accepting these general sales conditions, it is expressly agreed that after 3 days following delivery, the customer may not invoke product non-conformity.
Under the hidden defects warranty, www.tipimentrodrigues.com shall only be obliged to replace defective goods free of charge, without being liable for damages for any reason whatsoever.
It is the responsibility of the customer to prove hidden defects.
11 Article 10 - Right of Withdrawal
In accordance with the provisions of Articles L.221-18 and following of the Consumer Code, following an online order, the customer has a withdrawal period of 14 days, without any justification, from the date of receipt, by the Customer or by a third party designated by the Customer, of their order. If the deadline expires on a Saturday, Sunday or public holiday or non-working day, the deadline is extended until the next working day.
Return costs are the responsibility of the customer. The products must be in their original packaging.
In the event of exercising this right, www.tipimentrodrigues.com undertakes to reimburse the order excluding any delivery charges. The refund is made using the same payment method used by the customer within a maximum of 14 days.
The right of withdrawal cannot apply to products which, after delivery, are mixed with other products.
To exercise their right of withdrawal, the customer must clearly indicate their intention through 2 possibilities:

12 Article 11 - Product Returns
In the event of product returns, the Customer shall bear all risks and costs of return.
The products concerned must be in the same condition as delivery. The products must be in their original packaging, or if applicable, in new packaging sufficiently sturdy and properly sealed.
13 Article 12 - Liability and Invalidity
www.tipimentrodrigues.com shall not be liable for damages resulting from improper use or storage of the products.
In the event that one or more articles of these general conditions are declared invalid by the application of a new law, decree or as a result of case law, the other articles shall remain in force.
14 Article 13 - Force Majeure
www.tipimentrodrigues.com shall not be liable in the event of non-compliance with any of the obligations under these general conditions, which is due to an insurmountable and unforeseeable event or to a force majeure situation.
15 Article 14 - Intellectual Property
Domaine Hermitage France owns the website www.tipimentrodrigues.com and remains the sole rights holder. Furthermore, Domaine Hermitage France holds all texts, comments, works, illustrations, and images reproduced on the website www.tipimentrodrigues.com under intellectual property rights.
Any use, reproduction, or interpretation of our photographs, even partial, without prior agreement may be considered as counterfeiting within the meaning of the law.
16 Article 15 - Information on Personal Data Collection
www.tipimentrodrigues.com informs its customers and users that it creates an electronic file from the personal data provided by customers when placing an order or creating a customer account.
The customer has the right to access, rectify, and oppose personal data directly from their customer account at any time.
17 Article 16 - Banking Details
The banking details transmitted for payment of an order are not retained by www.tipimentrodrigues.com. Payment processing is done directly on the Monetico platform of the CIC/Crédit Mutuelle group.
18 Article 17 - Applicable Law - Jurisdiction
French law applies automatically to these general conditions. In the event of a dispute and in the absence of an amicable agreement, the dispute shall be brought before the competent of French courts.
